PREAMBLE

These General Terms of Use (hereinafter "Terms") govern all conditions of access and use of the online dating platform called "Tchin Tchin" (hereinafter "the Platform" or "the Service"), as well as all services, features and content offered by the Platform, whether current or future.

Tchin Tchin is a digital platform connecting consenting adults who wish to organize and participate in real and authentic meetings, limited to non-commercial social activities such as coffee, dinner, drinks, walks or various activities. The Platform exclusively facilitates this connection.

Mandatory acceptance: By accessing the Platform, creating an account, or using the Service in any way, you unconditionally and unreservedly accept these Terms in their entirety, as well as our Privacy Policy (available here), Cookie Policy, and any other policy or legal notice published on the Platform. If you do not accept these Terms, you must immediately stop accessing the Platform and not create an account. Your continued use constitutes full and complete acceptance of these conditions.

Nature of the contract: These Terms constitute an electronic contract binding the parties within the meaning of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN), Regulation (EU) 2016/679 of May 8, 2016 (GDPR), Law No. 2013-450 of July 16, 2013 of Côte d'Ivoire on the protection of personal data, and Law No. 2024/017 of Cameroon on the protection of personal data. Acceptance is evidenced by a positive act during registration.

THE NAME "TCHIN TCHIN" — SPIRIT AND CLARIFICATIONS

The name "Tchin Tchin" draws its origin from the Chinese expression "qǐng qǐng" (請請), meaning "I invite you" or "please". Popularized in French through cultural exchanges between France and China, this expression has become synonymous with conviviality, celebration and meeting. This is precisely the spirit that our Platform carries: the desire to go out, to meet, to toast to life and to great encounters.

Tchin Tchin fully embraces the festive and warm universe that its name evokes. The Platform is part of a culture of sociability, sharing and joie de vivre among responsible adults.

No alcohol promotion: While the name "Tchin Tchin" naturally evokes conviviality and toasting, the Platform does not aim to promote, market or encourage the consumption of alcoholic beverages. Tchin Tchin is not a player in the alcoholic beverage industry, does not sell any alcoholic products and receives no remuneration related to the sale or promotion of alcohol.

The types of dates offered on the Platform (coffee, dinner, drinks, walk, activity) are varied and do not imply any obligation or suggestion to consume alcohol. The choice of venue and beverages during a date is the exclusive freedom and responsibility of each User.

Regulatory compliance: In compliance with the Évin Law (Law No. 91-32 of January 10, 1991) and applicable regulations in the countries where the Platform operates, Tchin Tchin does not carry out any direct or indirect advertising in favor of alcoholic beverages within the meaning of these texts.

User acceptance: By using the Platform, you acknowledge that the name "Tchin Tchin" exclusively designates a service for connecting adults and in no way constitutes an incentive to consume alcohol.

1. DEFINITIONS

For the interpretation and application of these Terms, the following terms have the meaning assigned to them:

• User: any natural person of legal age (18 years or older) with the legal capacity to enter into a contract, who creates an Account and accesses the Platform.
• Account: the personal and confidential digital space created in the name of a User to access the Service's features and Platform tools.
• Profile: all public or semi-public information shared by a User, including first name, apparent age, photos, descriptions, age preferences, general location and other voluntarily highlighted data.
• Announcement: a publication created by a User (Announcement creator) proposing a specific date, including a date/time, type (coffee, dinner, drinks, walk, activity), general location and other details.
• Interest: the formal expression by a User of their interest in participating in the date proposed in a given Announcement, with the option to choose which contact data to share if accepted.
• Match: the mutual and irrevocable confirmation of a date between the Announcement creator and a User who expressed their Interest, after acceptance by the creator. Only one Match per Announcement is possible.
• Contact: a User's personal communication details (phone, email, WhatsApp ID or other messaging platform) voluntarily shared after a Match confirmation.
• Feedback: the review, rating (1-5 stars), comments and post-date information voluntarily provided by a User after the confirmed date and time.
• User Content: any information, data, text, photo, image, video, description or content of any kind provided, uploaded or created by a User on or through the Platform.
• Platform: the entire computer system, infrastructure, services, features, tools and content made available via the website, mobile application and any other digital channel owned or operated by Tchin Tchin.
• Service: the complete range of services offered by Tchin Tchin via the Platform.
• Publisher: Tchin Tchin, the entity responsible for publishing, operating and managing the Platform.
• Personal Data: any information relating to an identified or identifiable natural person, within the meaning of the GDPR and applicable laws.
• Force Majeure: any extraordinary event beyond the control of Tchin Tchin, detailed in section 28.
• Date: the actual physical meeting between two Users who have confirmed a Match, organized outside the Platform and entirely the responsibility of each User.

2. PURPOSE AND SCOPE

2.1 Purpose

These Terms govern all conditions and methods of access and use of the Tchin Tchin Platform. They apply to all services offered, without exception, as well as to all communications and interactions that take place there.

2.2 Geographic scope

The Platform is primarily offered to users residing in Côte d'Ivoire, Cameroon and other French-speaking African countries. However, it is technically accessible from any jurisdiction.

2.3 Applicability to all services

These Terms apply in their entirety to: access to the Platform, Account creation and management, Profile creation and management, publication of Announcements, expression of Interest, creation of Matches, exchange of Contacts, sharing of User Content, submission of Feedback, use of any present or future feature, and any interaction with the Platform.

2.4 Possible service updates

Tchin Tchin may at any time add, modify, suspend or remove services or features. The Terms will apply to these new or modified services as soon as they are posted online.

3. FORMAL ACCEPTANCE OF TERMS

3.1 Methods of acceptance

Acceptance during registration: Formal acceptance of the Terms must be evidenced by a positive and unambiguous act during the registration process. Users must check a box confirming their unreserved acceptance of the Terms, Privacy Policy and other applicable policies. This acceptance is mandatory to create an Account.

Non-acceptance: If you refuse to accept the Terms, you cannot create an Account, access the Platform or use the Service.

3.2 Binding and definitive nature

These Terms form a legally binding contract between you and Tchin Tchin. Your acceptance remains in effect as long as you use the Platform.

3.3 Required legal capacity

Mandatory legal age: By accepting these Terms and creating an Account, you solemnly declare that: (a) you are at least 18 years old; (b) you are a natural person of legal age with full legal capacity to enter into a contract; (c) you are not under guardianship; (d) you are not prohibited from accessing this type of service by court order; and (e) you reside in a jurisdiction where access to this type of dating platform is legally authorized.

3.4 Consequences of non-compliance

Any false declaration regarding legal age or legal capacity may result in: (a) immediate and permanent suspension of the Account; (b) loss of all access and data; (c) the User's liability for any damage caused; and (d) communication of available information to competent authorities if necessary.

Publisher's liability: In accordance with Law No. 2004-575 of June 21, 2004, Tchin Tchin cannot be held responsible for illegal content published by Users on the Platform, provided that it acts promptly to remove the content once informed. Reports of illegal content can be addressed to [email protected].

Copyright notice: All content, designs, codes, logos, trademarks and visual elements of the Platform (except User Content) are the exclusive property of Tchin Tchin and protected by international copyright and intellectual property laws.

5. ACCESS AND REGISTRATION CONDITIONS

5.1 Required access conditions

Legal age: You must be at least 18 years old at the date of registration. Tchin Tchin will refuse access to anyone under 18.

Legal capacity: You must be legally capable of entering into a contract.

Legality: Your access and use must comply with all applicable laws in your jurisdiction.

5.2 One account per person

Account uniqueness: Each User may only create and manage one Account in their name. Multiple accounts, shared accounts, or accounts created on behalf of another person are strictly prohibited.

5.3 Required registration information

You must provide at registration: first name, verified date of birth (18+), valid email address OR valid phone number (at least one), gender (male or female), general location (country/city), and at least one identity photo clearly representing you.

5.4 Obligation of truthfulness

You solemnly undertake to provide accurate, complete, up-to-date and truthful information during registration and at all times while using the Platform.

5.5 Identity verification

Tchin Tchin may request identity verification at any time via email, SMS or official documents. While initial verification is not mandatory for exploring the Platform, it becomes mandatory before receiving another User's contact information after a Match.

5bis. LEGAL AGE AND USER RESPONSIBILITY

5bis.1 Minimum age and civil majority

Tchin Tchin imposes an absolute minimum age of 18 years to create an Account. However, the age of civil majority varies by country. It is entirely up to each User to verify whether the legislation in their country of residence allows them to use an adult dating platform.

5bis.2 Full exemption of Tchin Tchin

Tchin Tchin cannot be held responsible if a User uses the Platform in violation of local legislation regarding the age of majority. The Platform only verifies that the User has declared being at least 18 years old.

5bis.3 Protection of young adults

Tchin Tchin implements reasonable measures to protect young adults (18-24 years), including age bracket visibility rules. These measures constitute a good faith effort and create no obligation of result.

5bis.4 Maximum age

The Platform is intended for people aged 18 to 70. Tchin Tchin reserves the right to refuse registration for anyone declaring an age over 70.

6. USER ACCOUNT MANAGEMENT

6.1 Creation and responsibility

Your Account is personal and non-transferable. You are responsible for maintaining the confidentiality of your password and access.

6.2 Security obligations

Secure password: You agree to create a complex password (at least 8 characters, including uppercase, lowercase, digits and special characters).

Unauthorized access notification: If you suspect unauthorized access to your Account, you must notify Tchin Tchin immediately at [email protected].

6.3 Right to refuse/suspend registration

Tchin Tchin reserves the absolute right to refuse registration or suspend/delete an Account without prior justification.

6.4 Deactivation vs. deletion

Temporary deactivation: You can temporarily deactivate your Account via settings. Your profile will not be visible, but your data remains stored.

Permanent deletion: You can request permanent deletion of your Account. Deletion is irrevocable.

6.5 Default settings

When you create your Account, certain settings are enabled by default in order to provide you with a complete experience from the moment you sign up:

Profile visibility: Your profile is visible by default in the announcement feed of other eligible Users (according to gender and age bracket rules). This means that your announcements, first name, age, city and photos may be viewed by other Users. You can disable this visibility at any time from your Account settings.

Notifications: Email notifications and in-app notifications are enabled by default. These notifications inform you of important events related to your Account (new interests received, confirmed matches, date reminders, cancellations). You can disable all or some of these notifications at any time from your Account settings.

Social sharing: When a link to one of your announcements is shared on third-party platforms (social networks, messaging apps), a preview may be generated that includes your first name, the date type, the city, and your primary photo, provided that your profile is visible. If you do not wish this information to appear in shared link previews, you can disable your profile visibility.

By creating your Account, you acknowledge that you have been informed of these default settings and agree that it is your responsibility to modify them according to your preferences via your Account settings.

7. USER PROFILE AND CONTENT

7.1 Required and optional information

Required fields: First name, date of birth, gender, email OR phone, at least one photo, general location.

Optional fields: Bio, detailed preferences, contact phone number, contact email, WhatsApp ID, types of activities sought.

7.2 Photo requirements

Minimum and maximum: You must upload at least 1 photo and at most 10 photos.

Photo authenticity: All photos must be authentic photos that genuinely represent you.

Appropriate content: Photos must not contain: nudity, explicit sexual content, violence, illegal content, brand logos, advertisements, faces of other people without written consent, or modified images intended to deceive.

7.3 General Profile authenticity

Your Profile must faithfully and honestly represent you. Fraudulent profiles are formally prohibited.

7.4 Bio and description

Your bio must be respectful, honest and not misleading.

7.5 Contact information

Contact information you choose to share in your Profile remains entirely your responsibility.

8. ANNOUNCEMENTS

8.1 Creation and validation

Valid content: Every Announcement must propose an honest, real and respectful date. Only these types are authorized: coffee, dinner, drinks, walk, activity.

8.2 Prohibitions in Announcements

Strictly prohibited in Announcements: explicit sexual content, paid services, illegal or violent content, discrimination, fraudulent content, commercial advertisements, external links, money requests.

8.3 Publication limits

One per day maximum: You can only create one Announcement per calendar day.

About 5 per week: You can only create about 5 Announcements per calendar week (Monday-Sunday).

8.4 Time horizon (14 days maximum)

Future date required: Every Announcement must propose a date within the near future. The date can never be more than 14 calendar days from the creation of the Announcement.

Date modification: You can edit an Announcement to bring the date closer, but you can never push it beyond the initial 14-day limit.

8.5 Deletion and expiration

Free same-day deletion: You can delete your Announcement for free on the day of creation, as long as no Match has been created.

Automatic expiration: Announcements automatically expire after the proposed date and time.

36. FINAL PROVISIONS

Final acceptance: By clicking the "I accept the Terms" button during registration, creating an Account, or continuing to use the Platform, you acknowledge having read, understood and accepted these Terms in their entirety.

Non-negotiable: These Terms are not negotiable. No User may negotiate or modify these terms.
